Here are our general Terms of Service:


CONFIDENTIALITY:

We will respect the privacy and confidentiality of your marketing plans, source materials, technical documents, trade secrets, and all other sensitive information.

SECURITY:

Every effort will be taken to ensure the security of your website; however in the event of a security incident or issue, our hourly rate may be implemented.

WEB STANDARDS:

We develop our websites to current web standards and can not guarantee that your website will always function as expected, due to changes to web standards beyond our control.

SEARCH OPTIMIZATION:

We follow current standards for Local Search, however we can not make any placement or ranking guarantees.

PORTFOLIO & CREDITS:

We reserve the right to place our link in the footer of your website, and to reproduce samples of your project in our portfolio and in any marketing and/or promotional materials.

 

After the initial consultation, we will provide you with a written proposal, summarizing the design and scope of your project and outlining all related costs and expenses. Upon your acceptance of the proposal and payment of the deposit, the following Terms of Service will apply.


SCOPE OF WORK:

The proposal covers only that which is described in the proposal; any additional work is subject to additional fees; this includes the addition of pages, graphics, or other significant features; changes to elements which have been finalized; significant changes in plan, scope, or direction of the project; and/or any page or element requiring more than two rounds of revisions. If you would like to add extra pages or new functionality, we will provide you with an estimate for the additional work.

COMMUNICATION:

We provide one complimentary in-person meeting to discuss your website and/or marketing requirements. All further discussions pertaining to the project and/or to revisions to the project, will be completed by email and/or phone. Requests for additional in-person meetings may be subject to a fee of $125 per meeting.

TIMELINE:

You agree to provide us with everything that we need to complete the project, as and when we need it, and in the format that we ask for. You agree to review our work, provide feedback and sign-off approval in a timely manner. We will endeavor to meet all the deadlines set, but we cannot be responsible for a missed launch date or a deadline if you have been late in supplying materials or have not approved or signed off our work at any stage.

DORMANT ACCOUNTS:

Accounts that become dormant during a scheduled period of work due to your unexpected absence, may be subject to a reactivation fee of up to $250.

CONTENT:

Unless otherwise stated, you agree to provide all content for the project, e.g. graphics, logos, photos, videos, promotions, documents, diagrams, text, and/or other related materials; in digital format, and labelled in an organized manner.

If required, we are able to assist with content creation services such as writing, photography, video, and/or other design services, at our regular hourly rate, or as otherwise agreed.

COPYRIGHT:

You confirm that any text, graphics, photos, artwork,  designs, trademarks, and/or other materials provided to us are fully owned and/or copyrighted by you, and/or you have permission from the rightful owner to use these materials for this project.

DELIVERABLES:

Deliverables for this project may include copies of logo and/or print designs in high-resolution format, plus copyright and/or license for any photos and/or artwork used in your designs and/or website. These files will be sent to you when the project is completed. Requests for replacement files may be subject to a fee of $95.

OWNERSHIP:

Ownership of the designs and deliverables for this project is automatically assigned to you when we receive your payment in full.

 

Airdrie Web Design Ltd. offers a variety of website maintenance and technical services such as, domain name registration, secure email service, website hosting and email, malware removal, software updates, security monitoring, and Google search optimization services.


WEBSITE HOSTING SERVICE:

We are under no obligation to provide compensation for downtime, for any reason, and expressly limit damages to the customer for any non-accessibility time or other down time to the pro-rated monthly charge during the system unavailability.

SERVICE PROVIDERS:

If you choose to opt-out of our website service plans, e.g. domain name registration, email, web hosting and/or website maintenance, you will be responsible for providing your own services unless other arrangements have been made. Additional setup and/or administrative fees may apply.

CANCELLATIONS:

Website hosting and ongoing maintenance plans may be terminated by either party, without cause, by giving the other party 30 days written notice by electronic mail.

In the event of the cancellation or non-completion of this project, you will be invoiced for all work completed up to the date of notification, plus any related expenses. Your deposit will be applied to these charges and you will be responsible for any outstanding amounts. All incomplete work will remain the property of Airdrie Web Design Ltd.

 

Payment indicates agreement with all Terms of Service.


PAYMENT TERMS:
  • All projects require advance payment before work can begin.
  • Amounts under $750 require full payment in advance
  • Amounts over $750 require minimum 50% deposit.
  • Estimated expenses such as software, printing and/or materials costs must be paid in advance.
  • All balances are due within 10 days of completion of the project or receipt of the service.
  • Balances not paid within 30 days will accrue a 10% per month penalty. Website accounts unpaid after 60 days may be subject to removal from public view unless other arrangements have been made.
  • Hourly rate: $100
  • Minimum charge: $75

MAILING ADDRESS/DROPOFF LOCATION

This is our mailbox/dropoff at the UPS Store on Main Street. The UPS Store is located between City Hall and the Airdrie Public Library. Cheques and other documents may be dropped off in-person during regular business hours: Monday to Thursday 9am to 6pm, Fridays 9am to 5pm, and Saturdays 10am to 4pm. Closed on Stat Holidays.

LIMITED LIABILITY:

Airdrie Web Design Ltd. makes no warranties or representations of any kind, whether expressed or implied for the service it is providing and will not be responsible for any damages that may be suffered by the customer, including loss of data resulting from delays, non-deliveries or service interruptions by any cause, or by errors or omissions of the Customer.

Under no circumstances, shall Airdrie Web Design Ltd., its offices, agents or any one else involved in creating, producing or distributing services, be liable for any direct, indirect, incidental, special or consequential damages that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission or any failure of performance, whether or not limited to natural disaster, communication failure, theft, destruction or unauthorized access to our records, programs or services; this includes but is not limited to the loss of data or loss of profit.

Notwithstanding the above, the Customer’s exclusive remedies for all damages, losses and causes of actions whether in contract, tort including negligence or otherwise, shall not exceed the amount which the Customer paid during the term of this contract.

Any dispute arising out of this Agreement shall first be resolved by mediation, if possible. This contract is entered into in the province of Alberta, and any necessary arbitration or litigation will take place in this province.

SATISFACTION GUARANTEE:

If for any reason you are not happy with our service, you will be able to move your account with minimal fuss. We will not restrict your ability to transfer your services to a new provider. Any outstanding fees, balances or charges must be paid in full before the account will be released.

WEBSITE EDITING:

We will not be responsible for any changes, errors, or other damages incurred to the site by you or by any third party.

OTHER WARRANTIES:

We do not provide warranties, guarantees or refunds. Any revisions and/or replacements will be made at our discretion.
